About Moore Kingston Smith

Moore Kingston Smith is one of the UK's top 20 audit and accountancy firms.

The technology and digital sectors have traditionally used the services of contractors, particularly for specific projects where taking on a full time employee cannot be justified, or because it allows specific skills to be brought in.

Following our seminar in November 2011, wrestling with the rules, where we looked at the tax aspects for contractors and freelancers as well as distinguishing between employment and independent contractor relationships in the technology and telecoms sector, we are now ready for round two.

In this second round of Wrestling with the rules, we will deep dive into the changes around IR35 and how this may affect contractors, issues around general anti avoidance as well as a review of the tax planning opportunities associated with, and the legal tests for employment versus independent contractors.

The seminar will cover:

GAAR, what does it mean?

current position of IR35

general anti avoidance rules

the taxation test of status

tax advantaged structures and their implications on the engager and employment law implications of status

Increasing use of interns, apprentices and voluntary workers
